The term ‘English Yes’ or ‘us’ or ‘we’ or ‘our’ refers to the owner of the website, English Yes, a brand which is operated on a sole trader “autónomo” basis by Paul Bull. The term ‘you’ refers to the user or viewer of our website. ORDERS All orders made through the website must be paid immediately upon receipt of an invoice. 2. SERVICES/PAYMENT a) Students registering (signing up) for group courses or individual (one or two students) courses will be required to pay monthly for the service in advance of the first day of the month, unless otherwise agreed in writing and signed by an English Yes official. b) Students registering (signing up) for a series of individual classes (clases particulares) will be required to pay monthly for the service in advance of the first day of the month, unless otherwise agreed in writing and signed by an English Yes official. c) Students registering (signing up) for individual or occasional classes (clases particulares) will be required to pay for the service in advance, unless otherwise agreed in writing and signed by an English Yes official. d) Students registering (signing up) for Skype / internet courses and classes will be required to pay under the same regulations as outlined in SERVICES (a) (b), and (c), unless otherwise agreed in writing and signed by an English Yes official. e) Registration and course reservation fees: Students wishing to reserve a place on a course or for a series of classes will be required to pay a 40 Euro reservation fee to secure the allocated and agreed time slot. This fee will then be deducted from their first monthly payment (course payment requirements are outlined in SERVICES (a) (b), (c) and (d),  unless otherwise agreed in writing and signed by an English Yes official. f) Our agreed payment terms will be set out on either the order form or in the written contract, depending on the service, unless otherwise agreed in writing and signed by an English Yes official. g) If payment is not made in accordance with the agreed terms, the buyer shall be deemed to be in default, and English Yes shall be entitled, without prejudice to any other rights it may have, to charge interest at the rate of 8% above the European Central Bank base rate, from time to time in force, until the amount owing is paid in full. English Yes reserves the right to charge the buyer for any legal costs involved in connection with the recovery of outstanding amounts due. h) Failure to make due payment for any product / service, under these terms, or any other contract between the buyer and English Yes, shall entitle English Yes to delay, suspend, or cancel work / services, or withdraw account facilities. i) If account facilities are withdrawn, then all outstanding invoices will immediately fall due for payment, and a demand as such will be made at the time of withdrawal of these facilities. 3. CANCELLATION a) After acceptance, orders made through the website shall not be subject to cancellation or alteration, except with the written and signed agreement of an English Yes official. b) Cancellation of orders for goods/services which meet the customers required specifications cannot be accepted. c) Cancellation or alteration charges may be applicable. d) Students who have signed up for courses but decide to leave before the end of the course for personal reasons are politely requested to give at least one week’s notice (or even further in advance if possible) of their intention to leave. 5. PROPERTY RIGHTS The property and title to the goods/services shall remain with English Yes. 6. THIRD PARTY HOSTING SERVERS English Yes cannot be held responsible for any technical problems caused by third party hosts or internet service providers that affect our online services. We will, however, negotiate with clients in a bid to resolve any such issues in a mutually satisfactory manner.
